In February 2020, in order to enhance the openness and transparency of legislation and improve the quality of legislation, the Ministry of Justice published the Regulations of the People's Republic of China on the Administration of Permanent Residence of Foreigners (Draft for Comment) (hereinafter referred to as the "Regulations"), which made clear provisions on the situation of foreigners applying for permanent residence in China.
2020年2月，为了增强立法的公开性和透明度，提高立法质量，司法部公布了《中华人民共和国外国人永久居留管理条例（征求意见稿）》（以下简称《条例》），其中对于外国人申请中国永久居留不予通过的情况做出了明确的规定。
Article 26 of the Regulations states:
《条例》第二十六条规定：
Under any of the following circumstances, the state immigration administrative department shall make a decision not to approve permanent residence:
外国人有下列情形之一的，国家移民管理部门应当作出不予批准永久居留的决定：
(1) Does not meet the application conditions or fails to provide application materials as required;
(1) 不符合申请条件或者未按照规定提供申请材料；
Interpretation: This article is easier to understand, when the foreigner does not meet the requirements for permanent residence in China or the materials provided do not meet the requirements, the application will not be successful.
解读：这一条比较好理解，当外国人不符合中国永久居留的申请条件或者提供的材料不符合规定时，申请当然不会成功。
(2) Suffering from serious mental disorders, infectious tuberculosis or other infectious diseases that may pose a major hazard to public health;
(2) 患有严重精神障碍、传染性肺结核病或者可能对公共卫生造成重大危害的其他传染病；
Interpretation: The application for permanent residence in China requires the applicant to be in good health, and the submitted application materials also have the requirements of health examination certificate. If the foreigner has a serious infectious disease or may cause major harm to public health, then the application for permanent residence will not be passed.
解读：申请中国永居需要申请人身体健康，提交的申请材料中也有健康体检证明的要求，如果外国人患有比较严重或可能会给公共卫生造成重大危害的传染性疾病，那么永居的申请也不会通过。
(3) It may endanger China's national security and interests and disrupt social and public order;
(3) 可能危害中国国家安全和利益、破坏社会公共秩序；
Interpretation: This article is also relatively easy to understand, foreigners want to live in China for a long time, then the minimum requirement is not to cause harm to China's national security, interests, social and public order.
解读：这一条也比较好理解，外国人想要在中国长期生活，那么最低要求就是不能对中国国家安全、利益、社会公共秩序等造成危害。
(4) Falsification in the application process;
(4) 在申请过程中弄虚作假；
Interpretation: This provision is relatively broad, and does not provide for specific behaviors, which are more common: submitting false application materials, meeting application conditions by illegal means.
解读：此条规定比较宽泛，并没有对具体行为做出规定，比较常见的有：提交虚假的申请材料、通过违法的方式满足申请条件等。
(5) The expenses for living in China cannot be guaranteed;
(5)不能保障在中国境内生活所需费用；
Interpretation: If you want to live in China for a long time, you need a certain amount of living security. When foreigners submit an application for permanent residence, the relevant departments will also focus on the applicant's conditions in this regard, such as whether there is a relatively fixed residence, family income and savings. (6) Other circumstances in which permanent residence in China is not appropriate.
